ARTE VENTURE PRODUCTION SRL, trading under the name SECTOR 1 GALLERY, is a limited liability company, incorporated in Romania, registration no. J23/897/2016, tax no. RO15553815, email: info@sector1gallery.com, contact address: 29 Băiculești Street, District 1, 013193, Bucharest, Romania (“Sector 1 Gallery”).
Sector 1 Gallery processes your personal data, as controller, for the purposes detailed below in this Privacy Policy. Personal data is processed in accordance with the provisions of Regulation (EU) 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (the “GDPR”).
Sector 1 Gallery owns and operates www.sector1gallery.com (the “Site”) and provides related products, services and newsletters (together with the Site, the “Services”) to the users of the Site.
By accessing the Site you declare that you have been informed about data processing by reading this Privacy Policy which is intended to provide information on the personal data processed by Sector 1 Gallery, the purpose and legal basis of the processing and your rights in relation to your personal data.
Please note that simply accessing the Site for information purposes only does not lead to the processing of personal data, but certain personal data can be obtained automatically (IP address, the type of device from which you access the Site, sole ID number of the device you are using, your internet connection speed, your location, the time at which you accessed the Site and other information about how you interacted with the Site). The personal data collected and processed by the controller is willingly provided by you as data subject or by third parties, who have your prior consent.
The Privacy Policy may be modified from time to time. The updated versions of the Privacy Policy will be posted on the Site and will be effective as of the date of its publication. Please make sure to periodically review our Privacy Policy.
PURSUANT TO THE PROVISIONS OF THE GDPR:
“processing” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;
“personal data” means any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
PERSONAL DATA PROCESSED BY SECTOR 1 GALLERY
Sector 1 Gallery processes the following categories of personal data:
- your full name, date of birth, address, phone number, email address, other contact or financial information that you voluntarily provide to Sector 1 Gallery in order to purchase products/services from our Site;
- your email address that you voluntarily provide when subscribing to our newsletter;
- your full name, date of birth, address, phone number, email address, other contact or financial information, your preferences in relation to the promotional materials sent by Sector 1 Gallery that you voluntarily provide to Sector 1 Gallery via email, phone or otherwise in order to receive promotional materials or any other relevant information in relation to the products/services provided by Sector 1 Gallery;
- data you provide to Sector 1 Gallery through your requests, complaints or your responses to Sector 1 Gallery surveys or market research;
- data relating to litigations, mediations or other administrative proceedings, as well as any allegations of fraud, theft or other illegal activities involving goods or persons connected to you and communications with the police, courts or any public authorities or institutions in relation to you or goods connected to you;
- data collected automatically when you browse the Site, such as your IP address, the type of device from which you access the Site, sole ID number of the device you use, your internet connection speed, your location, the time at which you accessed the Site and other information about how you interacted with the Site. Such information may be collected through the use of cookies or other similar technologies.
COOKIES
Cookies are small text files that a website saves on your computer, mobile phone or other devices with Internet connection when you access the website. Cookies can be used to identify a user’s computer and contain information about the manner in which web pages are viewed, such as the language in which the pages are displayed, the region of the globe where the user is located or the security settings. Cookies cannot read or understand other files or documents stored on your devices and do not contain information that can be used to identify a user by name. Cookies are widely used to improve website functionality.
The cookies on our Site will be activated following your explicit and prior consent. You may activate only certain cookies and withdraw your prior consent regarding the activation of certain cookies (optional cookies).
Sector 1 Gallery has the legal right to store cookies on devices, if it is strictly necessary for the operation of the Site. For all other types of cookies, the user’s permission is required. Please consider that in case of non-consent/withdrawal of consent for using certain cookies you may not be able to enjoy the full functionality of our Site.
The Site uses two types of cookies – session cookies and persistent cookies. Session cookies last only for the duration of one session and are deleted when the session ends. Persistent cookies are stored on your device, being read by the Site each time you access it from that device.
The Site may contain links to external providers, such as Facebook and Instagram through which you can perform certain actions. Please note that Sector 1 Gallery has no control over the cookie policies of such providers. Prior to viewing third party content you have to accept their terms and conditions.
PURPOSES AND LAWFULNESS OF PROCESSING OF PERSONAL DATA
The purposes for the processing of personal data and the corresponding legal basis for such processing are:
- the purchase of products/services by entering into and performing contracts, invoicing and delivering products. In this case, the collection of personal data will be done by concluding the contracts, by email, telephone or correspondence carried out in physical format and the legal basis for processing your personal data is the intention to enter into the contract or the concluded contract;
- providing promotional materials or any other relevant information in relation to the products/services provided by Sector 1 Gallery. In this case, the collection of personal data will be done if you have expressed your consent in this regard by subscribing to Sector 1 Gallery’s newsletter or otherwise or if such a right is granted by law;
- further developments of the Site, research, statistics, security, compliance and protection, in which case the legal basis for processing your personal data is the Sector 1 Gallery’s or a third party’s legitimate interest, such as, but without limitation to, preventing fraud, maintaining the security of goods or direct marketing.
Sector 1 Gallery will determine if there is a legitimate interest in processing your personal data following a careful assessment.
STORAGE PERIOD OF PERSONAL DATA
Sector 1 Gallery stores your personal data throughout the relationship between you and Sector 1 Gallery, as long as such data is necessary in order to fulfil the purposes for which they were collected or otherwise processed or for the period imposed by the applicable law (e.g., accounting purposes, reporting to the competent authorities).
After such periods, Sector 1 Gallery will delete or destroy your personal data. Sector 1 Gallery will review the processed personal data at least once every 2 years, and inaccurate or amended data will be corrected or deleted, unless the applicable law provides that it is mandatory to keep such data for longer time periods.
PROCESSING OF DATA AND DISCLOSURE OF PROCESSED PERSONAL DATA
Your personal data may be processed by Sector 1 Gallery employees who require such information for the achievement of the purposes for which such data is processed.
Your personal data may be disclosed/shared within the context of the following categories of third parties on a need-to-know basis as per the purpose of the processing:
- accountants, auditors, lawyers and other external consultants, if their activity entails knowledge of such data or when the disclosure of such data is required by the applicable law;
- product and service suppliers, such as marketing, transportation, shipping, insurance, telecommunications, IT system and IT support suppliers, including email archiving, suppliers of back-up and recovery services, suppliers of computer security or data storage services, credit institutions. Sector 1 Gallery will take appropriate contractual measures to ensure that such third parties process your personal data in accordance with applicable legal provisions;
- public authorities and institutions.
Your personal data may also be disclosed to third parties in circumstances such as the following:
- you ask us to disclose your personal data or you give us your consent in this regard;
- disclosure is necessary in order to comply with a legal obligation, in order to respond to a public authority’s request, in order to prevent acts contrary to the law or to defend a legitimate right or interest before a court of law;
- in order to protect the rights and safety of data subjects;
disclosure is necessary for Sector 1 Gallery to protect its own rights or the rights of its employees, contractual partners or third parties or to respond to a claim.
TRANSFER OF DATA OUTSIDE THE EUROPEAN ECONOMIC AREA
Certain recipients of your personal data referred to above may process your personal data in countries outside the European Economic Area.
If Sector 1 Gallery provides your personal data to recipients outside the European Economic Area, Sector 1 Gallery will take appropriate contractual measures to ensure that such recipients process your personal data in accordance with this Privacy Policy.
YOUR RIGHTS IN RELATION TO YOUR PERSONAL DATA
Certain recipients of your personal data referred to above may process your personal data in countries outside the European Economic Area.

The right of access
You have the right to obtain from Sector 1 Gallery confirmation as to whether or not personal data concerning you is being processed, and, where that is the case, to obtain access to the personal data and the following information:
- the purposes of the processing;
- the categories of personal data concerned;
- the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;
- where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;
- the existence of the right to request from Sector 1 Gallery rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing;
- the right to lodge a complaint with a supervisory authority;
- where the personal data is not collected from you, any available information as to their source;
- the existence of automated decision-making, including profiling, and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for you.
The right to rectification
You have the right to obtain from Sector 1 Gallery without undue delay the rectification of inaccurate personal data concerning you. Taking into account the purposes of the processing, you have the right to have incomplete personal data completed, including by means of providing a supplementary statement.
The right to restriction of processing
You have the right to obtain from Sector 1 Gallery restriction of processing where one of the following applies:
- you contest the accuracy of the personal data, for a period enabling Sector 1 Gallery to verify the accuracy of the personal data;
- the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead;
- Sector 1 Gallery no longer needs the personal data for the purposes of processing, but you require them for the establishment, exercise or defence of legal claims;
- you object to the processing, for the period of time during which it is verified whether the legitimate grounds of the controller override your legitimate grounds.
The right to withdraw consent
You have the right to withdraw your consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
The right to erasure (“right to be forgotten”)
You have the right to obtain from Sector 1 Gallery the erasure of personal data concerning you without undue delay where one of the following grounds applies:
- the personal data is no longer necessary in relation to the purposes for which they were collected or otherwise processed;
- you withdraw your consent on which the processing is based according to the applicable legal provisions and there is no other legal ground for the processing;
- you object to the processing on grounds relating to your particular situation and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing for direct marketing purposes;
- the personal data has been unlawfully processed;
- the personal data has to be erased for compliance with a legal obligation under Union or Member State law to which Sector 1 Gallery is subject.
Nonetheless, the erasure of personal data cannot be obtained in circumstances such as:
- personal data is processed for exercising the right of freedom of expression and information;
- personal data is processed for archiving purposes in the public interest, scientific or historical research or statistical purposes;
- personal data is processed for the establishment, exercise or defence of legal claims.
The right to object
You have the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you which is based on the legitimate interests of Sector 1 Gallery or of a third party. In such cases, Sector 1 Galler shall no longer process your personal data unless it demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.
Where personal data is processed for direct marketing purposes, you have the right to object at any time to processing of personal data for such marketing, which includes profiling, to the extent that it is related to such direct marketing.
The right to data portability
You have the right to receive the personal data concerning you, which you have provided to Sector 1 Gallery, in a structured, commonly used and machine-readable format and you have the right to transmit that data to another controller without hindrance from Sector 1 Gallery, when the processing is based on your consent or for the performance of a contract or when the processing is carried out by automated means.
The right not to be subject to a decision based solely on automated processing
You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.
However, you cannot exercise this right if the decision:
- is necessary for entering into, or performance of, a contract between you and a data controller;
- is authorised by the law to which Sector 1 Gallery is subject and which also lays down suitable measures to safeguard your rights and freedoms and legitimate interests; or
- is based on your explicit consent.
By reading this Privacy Policy you acknowledge that the aforementioned rights are not absolute rights and accept that there is a possibility that certain personal data used to achieve the purposes of processing may not be erased (for example, personal data in relation to which there is an obligation to report to public authorities or in relation to which there is an obligation to store for a period prescribed by law).
SECURITY OF PERSONAL DATA
Sector 1 Gallery makes every reasonable effort to protect your personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data transmitted, stored or otherwise processed, including through technical and organisational measures such as the control of physical access to Sector 1 Gallery’s headquarters, staff training and safe storage of documents, using encryption passwords to access Sector 1 Gallery’s system.
Sector 1 Gallery undertakes efforts to protect your personal data that are sent over the internet. However, please note that no method of transmission over the internet is completely secure. Sector 1 Gallery cannot guarantee the absolute security of the data you send over the internet and you are sending such data at your own risk.

We will attempt to respond to your requests, questions and complaints within 30 days as of the date of their receipt. In light of the complexity of your request, question or complaint, this 30-day period may be extended by two months. You will be informed about any such extension and the reasons justifying the extension.
If you submit requests, questions or complaints in electronic format, we will provide the requested information or reply in electronic format whenever possible, unless you expressly request us to provide such information or reply in a different format.
If Sector 1 Gallery is unable to properly identify you as a data subject, we are unable to process your requests, questions or complaints unless you provide us additional information enabling us to identify you. In such cases, we will inform you and give you the opportunity to provide such additional information.
Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with the National Supervisory Authority for Personal Data Processing.
